RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01602 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be entitled to 14 days of Post Deployment/Mobilization Respite Absence (PDMRA). APPLICANT CONTENDS THAT: He was told by the personnel readiness office at his base that he would be receiving 14 days for PDMRA. He requests a cash payment of $2,800 ($200 per day). The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Air National Guard (ANG) in the grade of Staff Sergeant (SSgt, E-5). His DD Form 214, Certificate of Release or Discharge from Active Duty, reflects he was on active duty this period from 13 June 2013 to 3 February 2014 and was released from active duty due to demobilization. According to Special Order TE-0009 dated 5 June 2013, the applicant deployed to Kandahar Airfield, Afghanistan for 190 days. PDMRA is a program intended to recognize Service members who after 19 January 2007 are deployed and mobilized beyond certain rotation frequency thresholds (12 months in any 72-month period for Reserve Component members) by awarding them administrative absence days. When a member mobilizes or deploys beyond these targets, administrative absences are granted to offer additional respite, to be taken at a time convenient to the member and family. The number of administrative absence days authorized is based on the number of months beyond 12 months that the Service member is deployed. Section 605 of the FY13 National Defense Authorization Act (NDAA) provides for the payment of $200 per day for the nonparticipation of eligible members in the PDMRA program due to government error. Members may submit an application to the AFBCMR for correction or use another process created by the Secretary concerned. AIR FORCE EVALUATION: NGB/A1PR recommends approval. A1PR recommends the applicant be compensated for 14 days of PDMRA and his records be corrected to reflect the points and applicable benefits for loss of 14 days of PDMRA to correct end date of tour from 3 February 2014 to 17 February 2014. PDMRA is an administrative absence applied to qualifying mobilized members. It is a use or lose benefit that must be approved by the member’s commander while serving in a mobilized status for the Reserve component. The applicant earned 14 days of PDMRA for 7 months of creditable mobilizations/deployments within the previous 72 month window. However, the unit did not implement the PDMRA policy for the applicant to utilize his earned days. The Defense Joint Military Pay System-Reserve Component (DJMS-RC) record reflects he did not perform military duty during from 4 February 2014 through 17 February 2014. A complete copy of the A1PR evaluation, with attachments, is at Exhibit B. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 18 May 2015 for review and comment within 30 days (Exhibit C). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. Having carefully reviewed this application, we agree with the opinion of the Air Force Office of Primary Responsibility (OPR) and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Although the OPR recommends the applicant’s tour end date be changed from 3 February 2014 to 17 February 2014, we recommend correcting the applicant’s record to reflect that he is entitled to payment of $200.00 per day for the 14 days of PDMRA credit he should have received at the conclusion of his mobilization tour. While this is not the relief recommended by the OPR, we believe it is proper and fitting as it is consistent with the applicant’s request, past practice and the provisions of Section 605 of the FY13 NDAA. Accordingly, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he accrued 14 days of Post-Deployment/Mobilization Respite Absence (PDMRA) when he was released from active on 3 February 2014, and should be paid $200.00 for each day of his PDMRA credit in accordance with the provisions of Section 605 of the Fiscal Year 2013 National Defense Authorization Act (NDAA).
